Lawyer Seeks Removal of Acting Inspector General Masengeli for Contempt of Court

A Kenyan lawyer has filed a petition seeking the removal of Acting Inspector General Gilbert Masengeli from office, claiming he is unfit for public service due to contempt of court.
The petition, brought by lawyer Charles Mugane, follows Masengeli’s failure to honor court summons related to the disappearance of Kenyans suspected to have been abducted.
Mugane argues that Masengeli’s conviction for contempt of court is an offense against the administration of justice and violates the principles of public service, rendering him unfit for his role. In his petition, Mugane states, “The Respondent needs to be removed after his conviction. His actions amount to a gross violation of the very Constitution he swore to uphold.”
The application seeks a temporary injunction to prevent Masengeli from continuing to act, serve, or perform any duties as the Inspector General of the National Police Service, citing the sensitivity of his conviction.
Mugane contends that Masengeli’s disregard for court orders sends a dangerous message to the National Police Service, implying that compliance with court rulings is optional.
The lawyer expressed concern over Masengeli’s open disregard for the judiciary, stating that it undermines the rule of law and poses a threat to the stability of Kenya’s governance.
He added, “This conduct should not be condoned in any manner.”
Mugane also emphasized that the public outcry over Masengeli’s actions reflects widespread concern over his suitability for public office, particularly in his role as Acting Inspector General.
According to the petition, Masengeli’s actions violate Chapter 6 of the Constitution of Kenya and the Leadership and Integrity Act, which sets ethical standards for public officials.
The lawyer further stated that his petition presents a strong case, as Masengeli’s behavior undermines the national values and principles of governance.
