Senior Principal Magistrate Amos Mokoross of Tamu Law Courts has sentenced a man to death for the crime of robbery with violence.
The accused, Kevin Onyango Kiyogo, faced two charges: robbery with violence under section 296(2) of the Penal Code, and stupefying to commit a felony under section 230 of the Penal Code.
In the first charge, Kiyogo, armed with dangerous weapons, violently robbed James Kamau of his Toyota Hilux valued at Ksh 1,800,000. The second charge involved administering an overpowering drug to Kamau.
These crimes occurred on June 23, 2023, in the Kogutu area of Muhoroni sub-county in Kisumu County.
Prosecutor Beatrice Langat presented evidence through testimonies from eight prosecution witnesses.
The court found these testimonies and exhibits compelling, concluding that Kiyogo, along with others not present in court, committed the offenses against Kamau.
In his judgment, Magistrate Mokoross sentenced Kiyogo to death for the robbery with violence charge.
For the second charge of administering an overpowering drug, Kiyogo received a five-year imprisonment sentence.
The death sentence will be held in abeyance until the completion of the five-year sentence.
