Two Former Embakasi South Employees Convicted for Defrauding Kshs 2.1 Million from the CDF

Two former employees of Embakasi South National Government Constituency Development Fund (NG-CDF), Peter Mukhanji and Nifrey Tero, have been convicted of defrauding Kshs. 2,199,823 from the fund.
They faced seven charges under the Anti-Corruption and Economic Crimes Act of 2003, including conspiracy to commit corruption, wilful failure to comply with procurement laws, fraudulent acquisition of public property, conflict of interest, and receiving a bribe.
The court found Peter Mukhanji guilty on the charge of willfully failing to comply with procurement laws by prematurely entering into a contract with Ewise Systems for the supply of computers before the mandatory 14-day waiting period post-notification of the tender award.
Nifrey Musilivi, the sole proprietor of Ewise Systems, was convicted of fraudulently acquiring public property amounting to Kshs. 2,199,823.
Both were jointly convicted for conspiring to defraud the Embakasi South Constituency of the mentioned amount.
Milimani Chief Magistrate Victor Wakhumile, in his ruling, highlighted that the prosecution’s evidence corroborated the charges, with further proof indicating that Peter Mukhanji had attempted to interfere with the case by stealing court exhibits, demonstrating a guilty mind and lack of cooperation.
