Case against two deceased Shakahola Massacre suspects dropped

A Mombasa court has dropped the Shakahola massacre case against two deceased accused persons.

Chief Magistrate Alex Ithuku made the direction following the Prosecution’s submission of burial permits and postmortem reports, detailing the deaths of the two suspects.

According to the official death reports, both the deceased died from illnesses.

Mary Charo Mbita died in June this year at Coast General Referral Teaching Hospital.

The second suspect, Edison Safari Munyambo alias Baba Sifa died on 19 August 2024 at Shimo la Tewa health facility.

The two bodies were released to the relatives for burial after the conclusion of the autopsy.

Meanwhile, Ithuku has directed the officer in charge of Shimo la Tewa women’s prison to appear and explain claims of maltreatment of female suspects.

The Shakahola massacre suspects including Mackenzie’s wife Rhoda Mumbua Maweu alleged to have been tortured including denial of food, sleeping on the floor and physical beatings, allegations which the court intends to confirm and address.

The magistrate indicated that the allegations were serious and that the officer in charge of the women’s prison should provide a comprehensive report.

The court directed the senior prison officer to appear on 11 September 2024 to answer those claims.

The officer was also directed to investigate the allegations and submit comprehensive findings.

The court also emphasized to the media and journalists to ensure they fairly and accurately report proceedings in the case, as it is of public interest.

The court also allowed the victims’ counsel application instructed by Haki Africa to participate in the matter.

Prosecutions team include Senior Assistant DPP, Peter Kiprop, Assistant DPP, Jami Yamina, PPC Betty Rubia, J.V Owiti and Alex Gituma, SPC Victor Simbi and PC Yassir Mohamed and PC Hilary Isiaho.
