EACC to Testify on Former Migori Governor and Family’s Involvement in Kshs.235 Million Public Funds Theft

Former Migori Governor Zachary Okoth Obado, along with his four children; Dan Achola Okoth, Scarlet Susan Okoth, Everlyn Zachary Okoth, and Jerry Zachary Okoth—and 11 other accused individuals will appear today, 8th July 2024, before the Milimani Anti-Corruption Court to face charges of alleged theft of public funds and conflict of interest involving the Migori County Government.

During the hearing, the first Prosecution Witness (PW1), an EACC Investigating Officer, will outline the fraudulent scheme orchestrated by the former governor, his children, and county officials.

The EACC’s investigation began after allegations surfaced of suspicious payments by the Migori County Government to various companies, amounting to Kshs.1.98 billion.

While most payments were found legitimate, Kshs.235 million remained unexplained and were deemed fraudulently acquired.

The investigation revealed that some of the illicit funds were used for kickbacks, including payments for the former Migori Governor ‘s children’s tuition fees at foreign universities and the purchase of high-end properties for the family.

These assets have been recovered through Alternative Dispute Resolution (ADR) following a civil recovery suit filed at the High Court.

Chief Magistrate Victor Wakumile will preside over the trial, which includes 59 witnesses lined up to testify against the accused.

If found guilty, the accused face penalties under the Anti-Corruption and Economic Crimes Act, 2003, including a maximum jail term of 10 years per offense and a mandatory fine of twice the amount of public funds lost or benefits gained.

Additionally, Section 64 of the Act prohibits convicted individuals from holding public office for 10 years.
